I. General Terms and Conditions

§ 1 Basic Provisions

(1) These terms and conditions apply to all contracts that you conclude with us as the provider (Maryna Polonska, operating under the name “Monbon”) via our online store. Unless otherwise agreed, the inclusion of your own terms and conditions is rejected.

(2) A consumer, within the meaning of the following regulations, is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By placing the respective product in our online store, we are providing you with a binding offer to conclude a contract under the conditions stated in the item description.

(3) The contract is concluded via the online shopping cart system as follows:

  • The goods intended for purchase are placed in the “shopping cart”.

  • You can access the “shopping cart” via the corresponding button in the navigation bar and make changes at any time.

  • After clicking the “Checkout” button or a similar button and entering your personal data as well as payment and shipping conditions, a summary of the order will be displayed.

  • By submitting the order via the “Buy Now” button or a similar button, you accept the offer, and the contract is concluded.

(4) Order processing and all information related to the conclusion of the contract will be carried out via email. You must ensure that the email address you provided is correct.

§ 3 Payment Methods

The available payment methods are indicated on the relevant page of our online store or in the respective offer.

§ 4 Right of Retention, Retention of Title

(1) You can only exercise a right of retention if it concerns claims arising from the same contractual relationship.

(2) The goods remain our property until the full purchase price has been paid.

§ 5 Warranty

(1) Statutory warranty rights apply.

(2) Consumers are requested to check the goods for completeness, obvious defects, and transport damage upon delivery and to notify us and the carrier of any complaints as soon as possible. This does not affect your statutory warranty rights.

§ 6 Choice of Law, Place of Performance, Jurisdiction

(1) German law shall apply. For consumers, this choice of law applies only to the extent that it does not withdraw the protection afforded by mandatory provisions of the law of the country in which the consumer usually resides.

(2) The place of performance for all services arising from our business relationships and the place of jurisdiction shall be our registered office, provided you are not a consumer.

(3) The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) are explicitly not applicable.

§ 7 Youth Protection

(1) When selling goods subject to youth protection regulations, we only enter into contractual relationships with customers of legal age.

(2) By submitting your order, you confirm that you have reached the legally required minimum age and that your name and address details are correct. You are also obligated to ensure that only you or an authorized adult receive the goods.

  • We do not store the contract text. Before submitting the order, you can print or save the contract data using your browser’s print function.

5. Prices and Payment Terms

  • All prices include the statutory VAT.

  • Shipping costs are not included in the purchase price and are displayed separately during the ordering process.
